Terms Of Trade

1. Ordering
1.1. Customers may purchase products from Atlas Co by sending a purchase order . The Customer will be deemed to have accepted the Terms and Conditions (Terms) by sending Atlas Co a purchase order.
1.2. The supply of products by Atlas Co is subject to market conditions which may affect availability from time to time. The Customer will be notified immediately of any event affecting the availability of any product on order.
1.3. It is the responsibility of the Customer to ensure accuracy of the order.
1.4. The responsibility of technical compatibility and/or fitness for a particular purpose lies with the Customer.

2. Payment
2.1. GSt & Freight are in addition to the purchase price and will be shown separately on Atlasco invoices.
2.2. The Customer must pay each Atlas Co invoice in full in accordance with agreed credit Terms.
2.3. The Customer must reimburse Atlas Co for any expenses and charges incurred by Atlasco in attempting to recover from the Customer any overdue amounts, including without limitation, debt collection and legal fees.

3. Order Cancellation
3.1. Orders once placed may not be cancelled without good cause.
3.2. In the event that an order is cancelled by the Customer it is agreed that Atlasco may charge a 20% cancellation fee.

4. Stock Returns for Credit
4.1. Non-faulty products can only be returned to Atlasco for credit at Atlasco discretion and will be subject to a 20% re-stocking fee. Please note Cisco Support Contracts and Licences are non refundable.

5. Warranty
5.1. Atlas Co provides a warranty on all equipment. Our standard warranty is days on all new and refurbished Cisco network hardware equipment. We provide a lifetime warranty on Atlasco branded peripherials.
5.2. Faulty goods must be returned to Atlas Co at the Customer’s expense for inspection within the warranty period. We will repair, exchange, or refund the cost of the equipment under warranty as quickly as possible after receipt at our warehouse.

6. Risk and Title
6.1.Atlas Co maintains ownership of any delivered products and packaging until all amounts owing on account for supplied products have been paid in full.

7. Indemnity
7.1. Customer indemnifies Atlas Co, its employees, agents and subcontractors against all losses, damages, expenses and costs that any of them may sustain or incur as a result, whether directly or indirectly, of any claim.
7.2. For the purposes of these Terms, "claim" means any claim by any third person for loss or damage to any property, injury to or death of any person or economic loss arising out of or relating to any or all of the products, any delay or failure in supplying the products and these Terms.

8. General
8.1. Both parties acknowledge that Atlas Co will supply products as an independent contractor.


These Terms contain the entire agreement between Atlas Co and Customer in relation to its subject matter.
